This work has to study the subjective judgment of Public Administration, passing by dilemmas notably related to an old conception of Administrative Law. Thus, they stand out initially administrative actions related and discretionary, revealing the importance of these to meet the social needs and the submission of both the dictates of the Constitution. Moreover, it is going to examine the possibility of control performed by the judiciary on Public Administration, identifying their limits, especially when it acts in the face of its own value judgment, in order to overcome the restricted view attributed to the principle of legality.
