The prostituted rhetoric and the necrosing scientificity of law

In the Brazilian philosophical and juridical traditions, the rhetoric study is insufficient before the thematic vastness that this discipline offers – this can be noted in the most important postgraduate programs. As a possible cause for this, we indicate an inherent fear concerning Philosophy and law studies developments, a fear that emerges as a weakness in the theories intended as absolutely affirmatives of the truth. Our proposal is to resume the Rhetoric study, in order to demonstrate how much both traditions lose for avoiding the fundamental role of the opinionated discourse concerning their disciplines. However, we intend to sustain the thesis that for its discourse forms, the rhetoric has been prostituted and, consequently, law started to die.Downloads
