Environmental refugee, Ethnical Identity and The Climate Change's Law

The climatic changes have and will cause adverse effects on the quality of human life, leading people to leave there homelands and moving to other countries. Such population displacements can worsen the conflicts that derive from the shock of different worldviews, since the refugees possess distinct culture and legal traditions from that dominant of the host country. This work aims to approach the questions related to the preservation of the ethnic identity of the environmental refugee and the challenges that will be launched to legal system of the host country that will encounter complex questions related to tolerance, values and national unity. We support the necessity of a new conception of Law capable of, at the same time promoting measures of mitigation and adaptation to the climatic changes and protection of the cultural rights of the environmental refugee, creating a society based on the harmonic coexistence of difference.Downloads
